Success Resources International Inc. ("SRI") Online Privacy Policy

SRI has established this Privacy Policy to explain how it protects and manages the personal information that it collects from you (the customer) online.

1. Consent for Collection, Use and Disclosure

Your use of this site and/or your registration for SRI products and services constitute your consent to the terms of this Privacy Policy. If you do not agree to the terms of this Privacy Policy, please do not use this site.

SRI may occasionally update this Privacy Policy. When it does, SRI will also revise the "last update" date at the top of this Privacy Policy. From time to time, we may also use collected information for new, unanticipated uses not previously disclosed in our Privacy Policy. If our information practices change at some time in the future, we will post the policy changes at our website to notify you of these changes and provide you with the ability to opt-out of these new uses. If you are concerned about how your information is used, you should check back at our website periodically. Additionally, under certain circumstances, SRI will not post policy changes or notify customers of changes, such as in connection with an investigation of a breach of an agreement, contravention of laws, an emergency where the life, health or security of an individual is threatened, the collection of a debt or in compliance with the request of a law enforcement agency or a court order.

A customer may withdraw his or her consent for collection, use and disclosure at any time by sending an email to clientservices@janetswitzer.com with the word "Unsubscribe" in the subject line. Please note that, if you do, SRI may suspend its provision of products and services to you. When you unsubscribe, if you fall within the guarantee period for any SRI product and you request a refund, the guarantee will be honored.

2. Accountability

SRI collects, at the time of your registration and your sign-on to its web site, certain "personal information" (information that personally identifies you) including but not limited to your name, email address, home or work address, telephone number, and information about your computer hardware and software (e.g., IP address, operating system, browser type, domain name, URL, access times, and referring web site addresses).

SRI has implemented this Privacy Policy to protect personal information received from its customers, and to respond to any inquiries. The Privacy Policy also provides that SRI will use appropriate contractual means to establish a comparable level of protection for personal information which is sent for processing by third parties on SRI's behalf. SRI has designated responsibility for your personal information to its Compliance Manager, who ensures compliance with the principles in this Privacy Policy. Other individuals may be delegated to act on behalf of the Compliance Manager.

3. Purposes for Collecting Personal Information

SRI collects and uses personal information for the following Identified Purposes:(a) to understand customer needs regarding SRI's services;(b) to develop and provide our web site and our products and services for our customers;(c) to fulfill your requests for products, services or information;(d) to communicate with customers and site visitors, when necessary, and to inform customers of upgrades, as well as of other products and services available from SRI, its affiliates and third parties;(e) to allow customers to access limited-entry areas of SRI's site;(f) to personalize some of our services and products for you and to deliver targeted advertisements and offers from SRI and third parties;(g) to bill accounts and maintain payment records;(h) to comply with any applicable law, regulation, legal process or government request;(i) to respond to a legitimate claim, or to address our reasonable belief, that you are violating the rights of any third party or any of the agreements or policies that govern your use of the SRI site or any SRI product or service;(j) to protect the services, products, content or rights of SRI and its designees, including but not limited to the security or integrity of the SRI site; and(k) to identify and resolve technical problems concerning SRI's site, products and services.SRI also uses personal information in an aggregate form (i.e., not individually attributable to you) for its business analysis, operational, marketing and other promotional purposes.If we contract with other companies to provide some products or services to our customers, then we will only provide those companies the personal information they need for the Identified Purposes, and we will limit their rights to use and further disclose your personal information as appropriate in the course of their work for us

.4. Limiting the Collection of Personal Information

SRI limits its collection of personal information to only that information which is necessary for the Identified Purposes. SRI does not direct its site to, nor does it knowingly collect any personal information from children under the age of thirteen.When you visit the SRI web site, a cookie may be placed on your computer or the cookie may be read if you have visited the SRI site previously. SRI uses cookies to allow SRI to determine which products and services you have already purchased so that SRI does not provide redundant information to you, and, if you are an SRI affiliate, to track SRI sales made to customers referred by you so that you can receive compensation under our affiliate program. If you choose to not have your browser accept cookies from the SRI web site, you may not be able to view all the text on the screens, or to experience a personalized visit, or to subscribe to certain service and product offerings on the SRI site.

5. Disclosure, Processing and Retention

SRI does not sell, rent or disclose your personal information to anyone else, except:(a) to someone you have designated to act as your agent, for one or more of the Identified Purposes (listed in Section 2, above); (b) to SRI's employees, independent contractors, subsidiaries, affiliates, consultants, business associates, service providers, suppliers and agents, acting at the request of SRI for any of the Identified Purposes;(c) as necessary if SRI has reason to believe that disclosure is necessary to identify, contact or bring legal action against someone who may be causing injury to or interference (either intentionally or unintentionally) with SRI's rights or property, other users of SRI's web site, products or services, or anyone else that could be harmed by such activities; and(d) to respond to judicial process and provide information to law enforcement agencies or in connection with an investigation on matters related to public safety, as permitted by law, or otherwise as required by law.In addition, as we continue to develop our business, we or our affiliates may sell or buy other businesses or entities, or we may merge with another company. In such transactions, personal information may be one of the transferred business assets. Also, in the event that SRI or substantially all of its assets are acquired, your personal information may be one of the transferred assets.Your information may be stored and processed in the United States, or in any other country in which SRI or its affiliates, subsidiaries or agents maintain facilities. By using this web site, you consent to any such transfer of information outside of your country. After your account becomes inactive (that is, if you request to be removed from our database), SRI will keep your personal information in its archives. Your information will then be used only as necessary for tax reasons or to prove SRI's compliance with any applicable law.

6. Accuracy of Personal Information

SRI will use reasonable efforts to keep customer personal information accurate for the Identified Purposes, and for minimizing the possibility of making inappropriate customer decisions based on such information. Customers are responsible for informing SRI about changes to their personal information. You can do this by calling (805) 499-9400 or by sending an email to clientservices@janetswitzer.com. SRI will use new or updated personal information it receives from customers to update its own records.7. Security SafeguardsSRI will use reasonable efforts to protect customers' personal information.

8. Access to Personal Information

SRI will afford you a reasonable opportunity to review the personal information in your file, if you so request by calling (805) 499-9400, writing to: Success Resources International Inc., 107 North Reino Road #415, Newbury Park, CA 91320 or upon request to the Compliance Manager at clientservices@janetswitzer.com.If SRI is not able to provide access to some aspect of a customer's personal information, it will provide reasons for denying access such as; that by doing so would likely reveal personal information about a third party, or that it is confidential commercial information or attorney-client privileged communications, or that the information relates to a breach of an agreement or a contravention of law, or that its disclosure could reasonably be expected to threaten the life or security of another individual.Customers have the right to request that inaccurate or incomplete information be amended as appropriate, by contacting SRI or the Privacy Officer as described above. SRI will promptly correct such personal information.

Product Purchase, Payment and Participation Terms

By purchasing a product or service at this website or any website selling products and/or programs published or provided by Success Resources International Inc., you agree that:

MEMBER SOLUTIONS WILL BE PROCESSING YOUR PAYMENT: Member Solutions, also referred to as "MBS," is an authorized agent to bill and collect monies on behalf of Success Resources International, Inc. (also referred to as "SRI"). MBS is not a collection agency, however, MBS may refer accounts to a collection agency or attorney for debt collection and/or credit reporting. Members Solutions imposes an additional fee of $25 for: (1) any scheduled credit card authorization that is not approved; (2) any check that is presented to MEMBER SOLUTIONS and subsequently returned or revoked for any reason; (3) any scheduled electronic funds transfer payment that is attempted by MEMBER SOLUTIONS and subsequently returned or revoked for any reason. Additionally, a $7.50 late fee will be assessed to your account for any scheduled installment payment 10 days past due. A courtesy 9-day grace period is provided, however all payments are due on their scheduled due date. Additional $7.50 late fees accrue at 30 day intervals. Customer acknowledges responsibility to maintain a valid working credit card on file with MEMBER SOLUTIONS for any recurring charges related to the purchase of an ongoing subscription product. If customer's credit card on file expires, the expiration date is often renewed for two years. Customer authorizes MEMBER SOLUTIONS to increase the expiration date two years and retry card. If approved, MEMBER SOLUTIONS will waive the initial $25 service fee.

YOU ARE PURCHASING A PRODUCT AND/OR PROGRAM FOR EDUCATIONAL PURPOSES: You understand you are purchasing an educational program and associated educational materials provided in a group format. Not all of the materials provided and not all of the methods discussed will be completely applicable to your particular business activities. You understand that you are participating and receiving advice as part of a group. You acknowledge that Janet and her designee(s) cannot be aware of all the particulars surrounding your business activities at all times. You will therefore adapt, to your own situation and of your own volition, any advice she gives you or that you hear her give to other participants. You understand that Janet may mention or direct you to resources in the form of vendors, suppliers, publishing professionals and independent contractors. You understand that these are for information purposes only and that Janet Switzer and/or SRI cannot be held responsible for remedies to you for any loss or damage you experience in dealing with these resources. You understand that Janet and/or SRI might receive remuneration, either actual or in kind, from these vendors, suppliers, professionals and contractors. You understand that the information that Janet will give you will not be all the information that exists on the subject of business growth, but is merely meant to compliment, amplify, supplement and direct you to other available information. You agree that Janet may — at her sole discretion — change, add to and/or substitute the educational materials described in this form and/or change, substitute, add to or schedule differently any teleconference call or other event described.

YOU HAVE THREE DAYS TO OBTAIN A REFUND: You state unequivocally that the date you purchase a product or register for a program ("your purchase date") is the first complete discussion of the Product/Program you have had with Janet Switzer or any associated parties and that your registration date also constitutes your purchase date, even though your credit card may be charged or your check may be negotiated at a later date. You understand that you may rescind this purchase agreement and request a refund within three (3) business days of your registration date for any reason, by writing to: Instant Income Client Services, 107 North Reino Road #415, Newbury Park, CA 91320 Attn: Program Director. You understand that should you rescind this purchase and request a refund in the manner described above, you will be granted a refund, but will receive your refund only if and when you return all materials previously provided to you, including but not limited to audio CDs, written materials, conference call recordings and DVDs. Any recision of this purchase and associated request for refund constitutes an express agreement by you to return all materials. Any failure by you to participate in any portion of a Program's activities does not entitle you to any extension of your Program past your scheduled completion date, nor does it entitle you to a refund of any Program Fees paid.

YOUR INTELLECTUAL PROPERTY AND IDEAS MAY BE EXPOSED TO OTHER PARTIES: You understand that, as part of your particiption in any program, Janet Switzer, Account Executives and other experts and scouts may review your business projects, ideas, training programs and business model(s) for the sole purposes of advising you during the Program and/or to direct you to individuals they may wish to further review such materials. You acknowledge that Janet Switzer, such experts and scouts and their related compan(ies) have other clients, many of whom may have material and ideas similar to yours, now or in the future. You also understand that your material, expertise, methods, proprietary business strategies, ideas and other concepts may be shared freely with others within and outside your Program, including consultants, outside experts and other participants. You expressly and irrevocably hold all parties harmless from any and all remedies, express or implied, from any perceived or actual plagiarism, incorporation or other use of your ideas that may occur, either during your Program participation period or afterward. You understand that Janet Switzer has not offered or implied any agreement to refuse participation in any Program to any competitor of yours nor to refrain from taking on as a client any competitor of yours. You understand that Janet Switzer and SRI reserve the right to refuse participation in any Program to any person for any reason, including but not limited to subject matter, market(s) and/or stated projects.

NO PROMISES ARE BEING MADE THAT YOU WILL EARN MONEY OR ACHIEVE SUCCESS: You understand and agree that Janet Switzer, SRI, nor its employees, officers, designee(s) nor assign(s) do not warrant any particular level of success from your participation in any program nor from your use of any educational product. You expressly acknowledge that no promises have been made to you, either express or implied, verbal or written, regarding any income you might earn or any fees you might earn back, including your original participation fee, due to your participation in any program or use of any product. You understand that Janet Switzer and SRI maintain consulting businesses that are separate from Products and Programs offered at this website. You understand Janet may choose equity-participation clients from amongst Product purchasers or Program participants, however, nothing written and/or stated verbally by any party is a guarantee that you will become an equity-participation client. Such offers can only be made in writing by Janet Switzer.

NO ONE IS LIABLE FOR DAMAGES YOU MAY INCUR FROM YOUR PARTICIPATION: You expressly agree to defend, indemnify and hold harmless Janet Switzer, SRI, their respective companies and officers, directors, employees, designees, agents and affiliates from all claims, losses, damages, judgments, liabilities, obligations, costs and expenses, including attorney's fees and costs, directly or indirectly incurred by any party related to any claim that arises from or in connection with your purchase/use of any Product or Program or from your participation in any Program. You further understand, acknowledge and agree that Coaches, Advisors, Account Executive and oExperts you may encouter are independent contractors to SRI and you agree to hold harmless SRI from all claims, losses, damages, judgments, liabilities, obligations, costs and expenses, including attorney's fees and costs, directly or indirectly incurred by any party related to any claim that arises from or in connection with your interaction with any of these contractors or their companies.

YOU ARE ALLOWING US TO RECORD YOUR PARTICIPATION: You agree to have Janet Switzer and her designee(s) audio record and use your participation in any Program or in connection with any Product purchase. You understand that Janet and her designee(s) have taped and/or intend to tape or otherwise record your participation in both telephone calls or other communications, both verbal and written. You consent to Janet's and her designee(s)' use of your name, city and state of residence, professional designation or occupation, appearance, image, statements and participation, in whole or in part, in these recordings or other derivative materials based on them, in any format now known or devised in future, in any geographic location, and you understand that Janet and her designee(s) intend to use them for educational, promotional and commercial applications. Janet Switzer and her designee(s) or their representatives do not have any obligation whatsoever to use all or any part of your participation in any Program, and Janet and her designee(s) may edit any audio or visual recording of your participation at their discretion. You agree that Janet Switzer and/or her designee(s) shall own all rights, title and interest, including copyright, in and to the originals and all copies of such audio, visual, or written recording, with full media and worldwide rights. Janet Switzer and her designee(s) shall have the right to reproduce, distribute, prepare derivative works based on, publicly perform and display, advertise, and publicize your participation in the Program and in these materials without compensation to you. You understand that final video and/or audio tapes prepared from the training session(s) and/or telephone calls may be made available to you for a nominal charge.
